The second and third weeks of September brought new provisional duties, the end of a five-year-old order on solar panels, and a safeguard decision now in the Cabinet’s hands. Here is what each means for importers.
Wheat gluten from Italy, Poland and the United Kingdom: provisional duties from September 17
On September 17, 2026, the CBSA made a preliminary determination of dumping on wheat gluten from Italy, Poland and the United Kingdom (WG2 2026 IN), usually classified under 1109.00.10.00 and 1109.00.20.00. Provisional duties apply to subject goods released on or after that date. The Canadian International Trade Tribunal opened its final injury inquiry (NQ-2026-006) on September 18, with its finding due by January 15, 2027.

Solar modules and laminates from China: duties end
The Tribunal terminated its expiry review (RR-2020-001) and rescinded its order of March 25, 2021, on photovoltaic modules and laminates from China, effective September 17, 2026. Anti-dumping and countervailing duties no longer apply to those goods.

Canned and frozen vegetables: safeguard report delivered
The Tribunal submitted its report on the global safeguard inquiry into certain canned and frozen vegetables to the Governor in Council on September 9. Finance Minister François-Philippe Champagne said the government will review it and announce a decision in due course. Until then, the 10% provisional safeguard surtax announced on June 10 remains in place for its maximum duration of 200 days, or until final safeguard measures replace it.

Expiry reviews: potatoes and rebar orders likely to continue
- Whole potatoes from the United States (for use or consumption in British Columbia): on September 11, the CBSA determined that expiry of the order is likely to result in continued or resumed dumping (POT 2026 ER). The Tribunal’s decision is due February 4, 2027.
- Concrete reinforcing bar: on September 17, the CBSA reached the same conclusion for rebar from Algeria, Egypt, Indonesia, Italy, Malaysia, Singapore and Vietnam (RB3 2026 ER) and from Oman and Russia (RB4 2026 ER). The Tribunal’s decisions on both are due February 24, 2027.
The existing duties stay in force while the Tribunal completes these reviews.
Upholstered domestic seating: review concluded
On September 15, the CBSA concluded an administrative review (UDS 2026 UP2) of upholstered domestic seating from China and Vietnam exported through the United States by Wayfair LLC. The ministerial-specification amounts of 188.0% (China) and 179.5% (Vietnam) continue to apply.
